Within the scope of using the website, users (“User”) may be required to provide personal data, that is, information provided by the User, which allows identifying and/or contacting them. it. In this sense, THE CODE follows strict criteria in the selection of service providers, in order to comply with its data protection obligations, committing to sign a data processing agreement with them. data, which includes, among others, the following obligations: apply appropriate technical and organizational measures, in a way that ensures the defense of the rights of the data subject; ensure that persons authorized to process personal data assume a confidentiality commitment or are subject to adequate legal confidentiality obligations; treat personal data for the agreed purposes and respond exclusively to THE CODE’s documented instructions; delete the data provided by THE CODE after the provision of services has been completed; and make available to THE CODE all the information necessary to demonstrate compliance with the aforementioned obligations, in addition to facilitating and contributing to audits, including inspections, conducted by THE CODE or by another auditor appointed by this mandate.
3. Legal basis
THE CODE treats the personal data collected on the following legal grounds:
3.1 In the case of the purpose identified in point 1.1.1, the legal basis for the processing of your personal data is THE CODE’s legitimate interest in maintaining the content of your Website constantly updated in order to provide you with useful and quality information;
3.2 In the case of the purpose identified in point 1.1.2. the legal basis for the treatment is your consent, which may be withdrawn at any time, without this, however, rendering the processing of personal data carried out based on that consent illegitimate until the date on which it is withdrawn.< /p>
Failing to provide your consent will prevent the sending of communications regarding the promotion of products and services relating to THE CODE and RACKETSPRO;
3.3 In the case of the purpose identified in point 1.1.3. the legal basis for the processing of your personal data is contractual execution.
4 How long do we keep your personal data?
The period for which we keep your personal data may vary depending on the purpose for which they were collected and processed. Therefore, we will keep your personal data for the following periods:
4.1. In the case of the purposes identified in points 1.1.1. and 1.1.3.: until such time as the personal data are no longer necessary for the fulfillment of this purpose;
4.2. In the case of the purpose identified in point 1.1.2.: until you withdraw your consent;
Without prejudice to the identified deadlines, your personal data will also be kept for the time necessary to comply with the legal obligations that apply in each case.

5 Rights of the holders of personal data

Requesting access to your personal data: the User has the right to obtain from THE CODE confirmation that the personal data concerning him are or are not object of treatment, also having the right to request access to your personal data and the following access information, which includes – among others – the purposes of data processing; the categories of personal data concerned; and, the categories of recipients or recipients to whom your personal data have been or will be disclosed
The User may also have the right to obtain a copy of the personal data being processed.
5.2. Request rectification of your personal data: the User has the right to request, at any time, the rectification of inaccurate personal data concerning him. Taking into account the purposes of the treatment, the data subject has the right to have his incomplete personal data completed, including by means of an additional declaration.
5.3. Request the erasure of your personal data: the User has the right to obtain the erasure of personal data, in particular when personal data is no longer necessary for the purpose what motivated its collection or processing; when the holder withdraws the consent on which the processing of personal data is based for one or more specific purposes and there is no other legal basis for said processing; when the User objects to the treatment under the right of opposition and there are no prevailing legitimate interests that justify the treatment; or if User data is processed unlawfully.
Personal data will not be erased, insofar as their processing proves necessary for the exercise of freedom of expression and information; for reasons of public interest in the field of public health (scientific or historical research), and for the purposes of asserting, exercising or defending legal claims.
5.4. Request limitation of the processing of your personal data: in certain circumstances, the User may have the right to obtain the limitation of the processing of your personal data, if you contest the accuracy of personal data; if the processing is unlawful and the data subject opposes the erasure of personal data and requests, in return, the limitation of its use; if the data are no longer necessary for the original purpose, but these data are required by the holder for the purposes of declaring, exercising or defending a right in a proceeding; and pending the decision on the holder’s objection to the treatment

5.6. Oppose the processing of your personal data: the User has the right, for reasons related to his particular situation, at any time, to oppose the processing of your personal data. In that case, THE CODE will cease processing your personal data, unless there are compelling and legitimate reasons for such processing that prevail over the interests, rights and freedoms of the data subject, or for the purposes of declaration, exercise or defense of a right in a lawsuit.
The holder of personal data also has the right to file a complaint with the competent data protection supervisory authority.
To exercise the aforementioned rights, or withdraw the consent given, the User may contact THE CODE by sending an email to the email address saveprivatedata@thecode.pt, indicating “Data Protection” as a reference and providing proof of your identity.
6. Update to this Privacy Policy
THE CODE reserves the right to change this Privacy Policy at any time, and in case of modification, the date of the last change, available at the top of this page, will also be updated . If the change is substantial, a notice will be posted on the Website.
This Privacy Policy, as well as the collection, processing or transmission of User Data, are governed by the provisions of Regulation (EU) 2016/679, of the European Parliament and of the Council, of 27 April 2016 and by the legislation and regulations applicable in Portugal, and any disputes arising from the validity, interpretation or execution of the Privacy Policy, or that are related to the collection, processing or transmission of User Data, shall be submitted exclusively to the jurisdiction of the Judicial Courts of the District of Lisbon, without prejudice to the applicable mandatory legal rules.
